Decades-old ULC files are being reopened — but nothing happens automatically

Telangana’s Revenue Department has ordered officials to take up pending Urban Land Ceiling (ULC) applications that have been sitting unresolved for years, in some cases decades.

Revenue Minister Ponguleti Srinivas Reddy announced the decision on Sunday, 27 September 2026. A memo — reported as Memo No. 48062/ULC/A1/2026-1 — directs officials to examine pending ULC applications filed under earlier government orders and to regularise eligible cases. The applications concern colonies that were either partially regularised or never regularised under the Telangana Urban Land (Ceiling and Regulation) Act.

The minister said a government order issued in 2016 had attempted to settle the same problem, but was never implemented, leaving thousands of applications unresolved.

The caveat matters as much as the announcement.

This memo does not switch anything on by itself. Press reporting on the order is explicit that properties under Section 22-A restrictions do not automatically become registrable — officials must examine each application individually and complete the legal and procedural requirements before anything changes. If your file is pending, it is now more likely to be looked at. It has not been decided.

What Urban Land Ceiling actually is

The Urban Land (Ceiling and Regulation) Act, 1976 capped how much vacant urban land one person or family could hold. Anything above the ceiling was “surplus”, and the surplus was to vest in the state government, which would then take possession of it.

In and around Hyderabad, that produced a situation that still shapes the property market today. Large holdings were declared surplus. Some of that land was taken over. Some was never physically taken. Plots were sold, colonies came up, houses were built, and decades later the paperwork underneath many of those properties still carries a ULC question mark.

That question mark is why owners in affected colonies find they cannot register a sale, raise a loan against the property, or complete a transfer — even though they have lived there for years and paid tax on it throughout.

The Act was repealed. So why is this still a problem?

This is the part that confuses most people, and it is worth getting right.

The central Urban Land (Ceiling and Regulation) Repeal Act, 1999 ended the ULC regime — but each state had to adopt it, and they did so on different dates. In Andhra Pradesh, the ULC Act was repealed with effect from 27 March 2008, carrying through to Telangana after the state was formed.

The repeal was not a clean slate. Section 3 of the Repeal Act saved cases where land had already vested in the government and the government had taken possession of it. Land that had genuinely passed to the state before 2008 stayed with the state. Everything else was supposed to fall away.

The fight, ever since, has been over which category a given parcel falls into — and that turns on whether possession was actually taken.

What the Supreme Court said in 2025

In M/s A.P. Electrical Equipment Corporation v. Tahsildar, decided on 27 February 2025, the Supreme Court addressed exactly this question. The reported holdings:

  • Vesting is not possession. Vesting under Section 10(3) of the ULC Act means vesting of title, not of possession. Mere vesting does not by itself give the state the right to physical possession.
  • The notices are mandatory. Authorities must issue notice under Section 10(5) to the landowner or other interested person; the requirements of Sections 10(5) and 10(6) are mandatory, not optional.
  • Paper possession is not enough. Where actual physical possession was never taken, and the mandatory notice was never served on the person in possession, the proceedings do not survive the repeal.

Important Fact-Specific Legal Note:

For an owner whose land was declared surplus on paper but never actually taken over, this is a significant point of law. It is also fact-specific: it turns on what happened on your particular parcel, what notices were issued and what the records show. Do not read it as a general rule that your ULC problem has disappeared. Read it as a reason to get the file examined properly by a lawyer.

What the new memo does

As reported, the memo directs officials to:

  • Take up pending applications filed under earlier government orders — reports name G.O.s 455, 456, 747 and 92
  • Prioritise colonies that were partially regularised or never regularised under the Telangana ULC Act
  • Regularise eligible cases after completing the procedural formalities

It sits inside a wider push. The Chief Minister told the Assembly on 16 September 2026 that the government would fast-track 10 to 12 key issues connected with Section 22-A. Since then a high-level committee has been formed, and orders have been issued permitting the registration of houses, plots and flats holding approvals from GHMC, HMDA, DTCP or municipal authorities even where they sit on the Section 22-A list.

Why ULC and Section 22-A are tangled together

Section 22-A of the Registration Act lets the government list properties whose registration is barred. One of its categories is ceiling surplus land — which is precisely what a ULC declaration creates.

So a ULC file that was never closed can surface years later as a survey number on the prohibited list, blocking registration for everyone who bought into that colony afterwards. Resolving the ULC application is, for many of these properties, the thing that has to happen before the 22-A entry can be addressed.

What to do if your property is ULC-affected

  1. Find out which file you are in. Identify the ULC application or proceeding number for your colony, and which government order it was filed under. Colony associations and your neighbours often have this — these applications were usually filed collectively.
  2. Establish what actually happened to the land. Was the surplus declared only, or was it taken over? Were notices issued, and to whom? After the 2025 Supreme Court judgment, this is the factual question that decides a great deal.
  3. Check your Section 22-A entry. Note which category your survey number is listed under. Ceiling surplus is a different problem from government land or assigned land, and the route out is different.
  4. Collect your approvals. If the colony has a GHMC, HMDA, DTCP or municipal layout or building approval, gather the sanction with its number and date, plus registered documents in your chain. The separate 22-A route for approved properties turns on exactly these.
  5. Follow the application rather than waiting for it. The memo directs officials to examine pending cases. Cases with a named applicant following up tend to move first.
  6. Take legal advice before you transact. Not after. A ULC-affected property can be sold only when the underlying issue is resolved, and an agreement signed in the meantime can leave you exposed.

Layouts in and around Hyderabad dating from the 1970s to the 1990s are exactly where ULC problems hide. Before you pay an advance:

  • Pull a 30-year encumbrance certificate and read the chain for gaps. See our Encumbrance certificate guide.

  • Ask the seller directly whether the land was ever subject to a ULC declaration, and ask for the file.
